Spell It Terms
Agreement
These terms are between you and Brogan LLC, (404) 490-0467, hello@brogan.io. They cover the Spell It app for iPhone and iPad and the website spellit.app. Using either means you accept them. How we handle data is in the Privacy Policy, which is part of these terms.
Who can hold an account
Account holders are adults. A child uses Spell It only through an adult's account, on a profile that adult created. You are responsible for everything done under your account, including by the learners you set up.
Subscriptions
Spell It's paid features are sold as auto-renewing subscriptions through the App Store. The price is shown before you buy. Apple bills you, renews the subscription until you cancel it in your Apple ID settings, and handles refunds under its own rules. Free features stay free.
Your content
The lists, definitions, and recordings you add are yours. You give Brogan LLC a license to store, process, and display them so the app can work, and, when you publish a share link, to show that list and its recordings to anyone who opens the link. The license ends when you delete the content or the share, subject to the retention windows in the Privacy Policy.
Sharing rules
Do not publish a shared list that is unlawful, harassing, or infringes someone else's rights. Brogan LLC may remove shared content that breaks this rule and may suspend the account that published it.
Our content
The Spell It app, its games, and its built-in lists belong to Brogan LLC. You may use them for personal and classroom use, and not otherwise copy, sell, or redistribute them.
Ending things
You can delete your account in the app at any time. Brogan LLC may suspend an account that breaks these terms, with notice to the email on the account.
Disclaimers and liability
SPELL IT IS PROVIDED AS IS, WITHOUT WARRANTY OF ANY KIND, AND WE DO NOT PROMISE THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE. TO THE EXTENT GEORGIA LAW ALLOWS, BROGAN LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM SPELL IT IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Nothing here excludes liability that Georgia law does not allow to be excluded.
Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Disputes go to the state or federal courts for DeKalb County, Georgia.
Changes
When these terms change in a way that matters, we give 30 days' notice in the app and by email to account holders. Using Spell It after the change takes effect means you accept the new terms.
